1. Acceptance of these Terms

These Terms of Use (the "Terms") govern your access to and use of the GoodSense RealEstate Advertising website at www.selectedluxuryinvest.com, including its property pages, search, maps, photographs and inquiry forms (together, the "Site"). The Site is operated by America Welcome Inc. ("America Welcome", "we", "us" or "our").

By using the Site or submitting a form, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. If you have signed a separate written advertising agreement with America Welcome, that agreement governs the paid advertising services and prevails if it directly conflicts with these Terms.

2. Eligibility

You must be at least 18 years old to use the Site or submit a form. By using the Site you confirm that you are 18 or older and that your use complies with applicable law.

3. Our limited role

America Welcome is an independent advertising and marketing company. It is not a real estate broker, brokerage, agency, appraiser, lender, attorney or property manager, and it does not represent buyers, sellers, owners, landlords, tenants or real estate professionals.

America Welcome does not take listings, value, sell, buy, rent or lease property, recommend one property or professional over another, qualify buyers, schedule or conduct showings, negotiate prices or terms, prepare offers or contracts, or take part in any transaction.

4. Fixed advertising fees

America Welcome is paid only a fixed fee for approved advertising and marketing services. It receives no commissions, referral fees, or compensation tied to a transaction, to the value of a property or to the number of inquiries. Using the Site does not oblige anyone to buy our services.

5. Property information

Property information, prices, availability, measurements, photographs, maps and descriptions are provided for general information only. They are supplied by the owner or by the licensed professional responsible for the listing, or taken from sources believed to be reliable, and are not independently verified by America Welcome. They may be inaccurate, incomplete or out of date and may change or be withdrawn without notice.

Maps on the Site show only an approximate area, deliberately wider than the actual location, and must not be used to identify a specific address. Market reports summarize third-party sources and are not appraisals or investment advice. Nothing on the Site is an offer, a contract, a guarantee of availability or a recommendation to buy, sell or invest.

Before making any decision you must verify all material information yourself and obtain advice from appropriately licensed real estate, legal, tax, financial, engineering or construction professionals.

6. Inquiries

When you submit a form, America Welcome receives your inquiry administratively and forwards it to the owner or licensed professional who purchased or authorized the related advertising space. We do not evaluate, select or qualify the person making the inquiry. The recipient is solely responsible for any reply and for all later communications, disclosures, showings, negotiations and transactions.

7. Consent to be contacted

By submitting a form you ask to be contacted about the property or topic you selected, and you agree that the owner or licensed professional who receives your inquiry, and America Welcome, may reply by email or by telephone at the contact details you provided. You are not required to agree to marketing messages to use the Site, and you can ask at any time to stop non-transactional messages. Electronic notices we send you satisfy any requirement that they be in writing.

8. Advertiser responsibilities

Anyone who supplies property information or materials for the Site represents that they own the property or have valid authority to advertise it; that the information is accurate, current and not misleading; that they hold all rights needed for the photographs, videos, plans and trademarks supplied; and that the advertising complies with federal, state and local law, fair housing rules, licensing and MLS rules and platform policies. America Welcome may refuse, correct, suspend or remove any content that appears inaccurate, unauthorized, unlawful or discriminatory.

9. Fair housing

America Welcome supports the letter and spirit of the federal Fair Housing Act and related state and local laws. Advertising on the Site must not indicate any preference, limitation or discrimination based on race, color, religion, sex, disability, familial status, national origin or any other characteristic protected by law.

10. Acceptable use

You agree not to: submit false, misleading or unauthorized information; impersonate any person or misrepresent ownership, licensure or authority; use robots, scrapers or other automated means to copy content from the Site or to collect information about others; send spam or malicious code; interfere with the security or operation of the Site; or use the Site for any unlawful or discriminatory purpose.

11. Intellectual property and copyright

The design of the Site, the GoodSense and America Welcome names and the original text and graphics created by America Welcome belong to America Welcome Inc. or are used with permission. Photographs and other property materials remain the property of their respective owners or licensors. You may view the Site for your personal, non-commercial use; any other copying, reproduction or distribution requires written permission.

If you believe that content on the Site infringes your copyright, send a notice to info@america-welcome.com identifying the copyrighted work, the specific material and page concerned, your contact details, a statement of good-faith belief that the use is not authorized, and a statement, under penalty of perjury, that the information is accurate and that you are the owner or are authorized to act for the owner. We will review valid notices promptly and remove or disable material where appropriate.

12. Feedback

If you send us suggestions or comments about the Site, you allow us to use them freely, without any obligation to you, to improve the Site and our services.

13. Third-party sites

Links to listings, brokerages, social networks or other third-party services are provided for convenience. America Welcome does not control or endorse them and is not responsible for their content, availability or privacy practices.

14. Disclaimers and limitation of liability

THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW. AMERICA WELCOME DOES NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE ACCESS, THE ACCURACY OF ANY LISTING, OR ANY NUMBER OR QUALITY OF INQUIRIES, SALE, PURCHASE, LEASE OR OTHER RESULT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMERICA WELCOME WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOST PROFITS OR OPPORTUNITIES, OR DAMAGES ARISING FROM A REAL ESTATE TRANSACTION, FROM THIRD-PARTY CONDUCT OR FROM INACCURATE INFORMATION. Nothing in these Terms excludes liability that cannot be excluded by law.

15. Indemnification

To the extent permitted by law, you agree to defend and indemnify America Welcome against third-party claims arising from your misuse of the Site, from materials you supplied, or from your violation of these Terms or of the law.

16. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where applicable law requires otherwise. Subject to any rights that cannot be waived, disputes about these Terms or the Site will be brought in the state or federal courts with jurisdiction in Pinellas County, Florida.

17. Notice to California residents

Under California Civil Code Section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. 18. Changes and language versions

We may update these Terms by posting a new version on this page and changing the "Last updated" date; continued use of the Site after the update means you accept the new Terms where permitted by law. If any provision is unenforceable, the rest remains in effect. Translations are provided for convenience; if a translation differs from the English version, the English version prevails to the extent permitted by law.
